Welcome to http://www.biere-amsterdam.com/ (hereinafter the "Site"). By visiting the Site, you agree to these terms and conditions of use (hereinafter the "Terms of Use"). If you disagree with certain clauses in the Terms of Use, we invite you not to use the Site.

The Site is operated by the company ASAHI UK LTD (trade name "ASAHI FRANCE" registered in the Paris Trade and Companies Register under number 821560760, domiciled at 10 Rue du Faubourg Poissonnière - 75010 Paris (hereinafter "Asahi", "we", "our"),

The purpose of these Terms of Use is to define the conditions under which ASAHI makes available to any visitor (hereinafter "Visitor", "you", "your") the Site, whose purpose is to inform the public about our activities.
  1. Minimum age
Certain portions of the Site are not accessible to minors or under the age of legal purchase of alcohol in the country, state, province or territory from which you are viewing this Site. Before you can access those parts of the Site, you will need to confirm your age.
  1. General material and technical prerequisites
Access to the Site can only be offered to Visitors with a compatible computer configuration, respecting the following prerequisites:

  1. Conditions of access to the Site

The elements present on the Website (photographs, texts, slogans, trademarks, logos, drawings, images, databases, animated sound sequences, etc.) as well as the Website's source code are the property of ASAHI or third parties having authorized ASAHI to use them. The use of all or part of the Site, in particular by downloading, reproducing, transmitting, representing or broadcasting it for purposes other than for your personal and private use for commercial or non- commercial purposes is strictly prohibited. It is also prohibited to extract or reuse quantitatively or qualitatively substantial parts of the content of any of the databases on this Site without prior authorization from ASAHI, whether or not these databases are protected by articles L.341-1 et seq. of the French Intellectual Property Code. Violation of these provisions subjects you to the penalties provided for by law.
  1. Hypertext links
ASAHI authorizes the creation of a hypertext link to its content, subject to the following conditions:
  • not to use the deep linking technique, i.e. the pages of the Site must not be nested within the pages of another site, but accessible by opening a dedicated window; and
  • to mention the source which will point through a hypertext link directly to the targeted content.
This authorisation does not apply to websites disseminating information of a controversial, pornographic or xenophobic nature or which may, to a large extent, offend the sensitivity of the general public. Third party sites with a hyperlink to the Website are not under the control of ASAHI, which therefore declines all responsibility for their content. You are solely responsible for their use.
  1. Commitments of the User
By visiting the Website, you agree to (i) not use the Website for illegal purposes; (ii) not use the Website in a manner that could interrupt, damage, harm or render the Website less efficient; (iii) not transfer files containing viruses, Trojan horses or any other harmful computer program; (iv) not attempt to circumvent the Website's security measures; and/or (v) not use the Website in a manner that could damage ASAHI's reputation, name or image.
  1. Site Availability
ASAHI strives to provide access to the Website 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond ASAHI's control, and subject to any breakdowns and maintenance interventions necessary for the proper functioning of the Website and services. ASAHI may not be held liable in the event of inability to access the Website and/or use the services.
  1. Responsibility
ASAHI's liability can only be engaged in the event of fault, negligence or breach of its obligations having caused you direct damage. The information accessible via the Site is provided as is. You will be solely responsible for your use of this information. In the event of incorrect information on the Site, ASAHI undertakes to correct it as soon as it is brought to its attention.

  1. Modification of the Terms of Use
ASAHI reserves the right to modify these Terms of Use at any time. Please check these Terms of Use regularly to be informed of any changes.
  1. Transfer
You may not transfer or assign your rights or obligations under the Terms of Use without the express written permission of ASAHI. ASAHI may transfer its rights and obligations under these Terms of Use to another company. You hereby consent to ASAHI's transfer of these Terms of Use to a third party regardless of the nature of such transfer, including but not limited to assignment, merger, absorption, spin-off, partial capital contribution, transfer of our assets and liabilities. This transfer will come into force when ASAHI informs you of it. You hereby agree that the transfer of the Terms of Use to a third party will result in a future waiver of your rights against ASAHI.
  1. Applicable law and competent courts
These Terms of Use are subject to French law. The courts of Paris (France) have exclusive jurisdiction to hear any dispute arising from the use of the Site or the interpretation, execution or termination of these Terms of Use.
  1. Severability clause
If any provision of these Terms of Use, including this provision, were to be declared wholly or partially null and void or unenforceable by a competent court, the remaining provisions or parts thereof would not be affected and would remain valid and enforceable (unless the voided provision was deemed by the competent court to be an essential obligation of ASAHI). In lieu of the unenforceable or void stipulations, the statutory provisions shall apply.
